These Terms and Conditions govern your use of the Injectly mobile application and related services operated by injectlyapp.com. By downloading, accessing, or using the Application and any services made available through it, you agree to be bound by these Terms; if you do not agree, do not use the Application. Injectly provides a medical injection delivery service that includes, but is not limited to, delivery and administration of prescribed injections by licensed healthcare professionals, personalized vitamin injections tailored to individual needs based on consultation with qualified healthcare providers, and corporate wellness programs offering vitamin and health-related injectables as part of employee health initiatives. All services are provided in accordance with applicable medical and regulatory standards where the service is offered, and availability may vary by location. Injectly is not a substitute for a physician, emergency services, or in-person clinical care; the Application’s content and services are for informational and convenience purposes only and do not constitute medical advice. Injections and treatments are administered only by licensed medical professionals and only where legally permitted; you must have any required prescriptions, medical clearance, or approvals from a licensed healthcare provider when applicable. The Service Provider does not guarantee specific health outcomes and individual results may vary; you must seek immediate emergency medical attention for any serious or life-threatening adverse reaction.
You represent and warrant that you are at least 18 years old or have parental or legal guardian consent to receive services through the Application. You must provide full, accurate, and up-to-date medical information, including existing conditions, medications, allergies, and prior adverse reactions, and you must inform Injectly’s healthcare professionals of any contraindications affecting treatment. Failure to provide accurate information or to follow healthcare professionals’ instructions may result in denial of service and may increase the risk of adverse outcomes; Injectly is not responsible for complications arising from incomplete, inaccurate, or withheld information. You are responsible for maintaining the security of your device and any credentials you use to access the Application. Some features require an internet connection, and you are responsible for data or connectivity charges imposed by your network provider.
Fees and payment terms for services will be presented to you at the time of booking; payment is required according to the terms displayed in the Application. Injectly reserves the right to change pricing and fees at any time and will reflect pricing changes in the Application; bookings made prior to a pricing change will be charged at the price displayed at the time of booking unless otherwise stated. Injectly’s provision of services is subject to the availability of licensed healthcare professionals in your area and to compliance with local laws and regulations; certain injectable treatments may not be available in all jurisdictions. The Service Provider may use third-party services and vendors to operate the Application and to perform portions of the service; such third parties have their own terms and privacy practices and Injectly is not responsible for their conduct.
Injectly collects and processes personal and health-related information to provide, manage, and improve the Application and services. All such data is handled in accordance with the Injectly Privacy Policy and applicable data protection laws, including, where applicable, HIPAA in the United States and the GDPR in the European Union. By using the Application you consent to the collection, use, storage, and transmission of your personal and medical data as described in the Privacy Policy. Injectly implements reasonable administrative, technical, and physical safeguards designed to protect the confidentiality and integrity of your data, but no data transmission or storage system can be guaranteed to be 100% secure; Injectly cannot warrant absolute security and is not responsible for unauthorized access beyond its reasonable control.
To the fullest extent permitted by law, Injectly, its affiliates, officers, directors, employees, healthcare providers, contractors, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of business, loss of goodwill, or loss of data arising out of or in connection with your use of, or inability to use, the Application or services. You acknowledge there are risks inherent to injections and injectable therapies, including but not limited to pain, bruising, infection, allergic reaction, and other adverse effects; by using the Application you accept these risks. Injectly’s total aggregate liability for any claim arising from or relating to these Terms or the services provided shall not exceed the total amount you paid for the specific service that gave rise to the claim, or, if no payment was made, a nominal amount as permitted by law.
Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Application, or any services provided shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association (or another arbitration provider selected by Injectly where required by local law). Arbitration will be conducted on an individual basis; you and Injectly each waive the right to a jury trial and agree not to participate in any class, collective, or representative action or proceeding. These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, unless otherwise required by applicable local law, and nothing in these Terms shall prevent Injectly from seeking injunctive or other equitable relief in any court of competent jurisdiction.
Injectly may update or modify the Application, services, and these Terms at any time; material changes will be communicated to you through the Application or by other means where required by law. Continued use of the Application after changes are posted constitutes your acceptance of the revised Terms. Injectly may suspend or terminate access to the Application or services at any time for any reason, including for maintenance, suspected fraud, security concerns, or legal compliance; upon termination, your right to access or use the Application will cease and any outstanding obligations (such as payment for services already provided) will survive termination.
For corporate wellness programs, separate agreements between Injectly and the corporate client will govern scope, scheduling, fees, liability allocation, employee eligibility, consent processes, and any reporting or data handling specific to the corporate relationship; employers must ensure that any employee participation complies with workplace policies and applicable laws. Injectly is not responsible for employer decisions regarding program implementation or for employer communications or representations made outside of the contracted agreement.
